that where an individual committed for extradition by a Magistrate
has been discharged on an Habeas Corpus at the hearing of which
the merits of the case have been the grounds for the discharge he
may, if a second application for his extradition is made, plead
that having been once thus discharged on an Habeas Corpus, he can-
-not be successfully proceeded against for extradition for the same offence; yet, it seems quite clear from the most modern legal
decisions, that (on such ples can be successfully raised if his discharge on Habeas Corpus has been on technical grounds alone; in
other words, if his discharge on Habeas Corpus was on the ground
that on the facts of his case there was no reason why he should be
surrendered he might perhaps plead res judicata; but where his dis- -charge on Habeas Corpus has been on the ground that the procedure before the agistrate was technically irregular, he could not avail himself of such a plea. Mr. Hazeland, so far as I can judge from his Judgment, has not addressed himself to this aspect of the law at all; but bases his decision on a different and I venture to
think a fallacious view of the position; the ground of his decision appears to be that his view is that when an order for extradition granted by a lagistrate was intrinsically illegal, the plea of res judicata could not successfully be raised, whereas when an order for extradition made by a lagistrate was not in- -trinsically illegal but was found subsequently on Kabeas Corpus proceedings to have been illegally granted then the plea of res judicata may be successfully raised. He considers that Mr. Irving's order was not intrinsically invalid and consequently he considers that the plea of res judicata is effective in this case. The fallacy lies in the failure to recognize that the intrinsic validi- -ty of the original order is no factor in the matter at all. The real point as to whether a plea of res judicata may be successfully raised depends upon whether the discharge of an individual on Hebeas Corpus proceedings was on technical or non-technical grounds. But further than this it is extremely doubtful whether the Magistrate has any power at all to consider and decide upon a plea of rea judicata upon an application in extradition; in my
